In this case, you will send us and we will collect the data you provide via email: company name or identification data, contact person’s name, contact details of that person. As an Applicant, in some cases, you must also send us other information regarding your request, necessary to prepare the offer (e.g., job title, number of staff required, salary grid, type of contract, etc.); this requirement is not contractual, but we need some information to respond to your request. If you do not agree, please do not send it to us.

f) In the case of Beneficiaries, we will keep a record of any correspondence. We will store only the data transmitted that helps us fulfill the contract’s purpose. If you, as a Beneficiary, do not agree, please do not send us emails or personal information.

g) Any other personal information you provide to us by sending the email, through the body or attachments of that email, is at your discretion. You must keep in mind that if you contact us via email, we will keep a record of that correspondence.

Information Collected via Phone:

a) We will collect all the information you provide to us via phone when you use our phone number to contact us, especially your phone number, name, surname, email address, and the reason for contacting, either partially or fully. You choose to share this data with us (partially or fully) when you contact us via phone. If you do not agree, please do not send it to us.

b) If you choose to provide us with personal information via phone, you must be aware that we will keep a record of the correspondence. If you do not agree, please do not send it to us.

c) If you choose to provide us with personal information via phone, you must be aware that if we request additional information, this requirement is not contractual, but we need some information to respond to your request. If you do not agree, please do not send it to us.

d) If no other electronic option is available, you may choose to have us assist you and help you complete your CV. In this case, you will send us and we will collect the following data from your CV: name, surname, phone, email, date of birth, city of residence, current and previous job positions, periods worked, job titles, education, study periods, courses, universities/high schools attended, specialization/profile completed, foreign languages spoken and proficiency level, driver’s license status. If you do not agree, please do not send it to us.

e) You may choose to send us your personal data as an Applicant via phone. In this case, you will send us and we will collect the data you provide: company name or identification data, contact person’s name, contact details of that person. As an Applicant, in some cases, you must also send us some additional information regarding your request, necessary to prepare the offer; this requirement is not contractual, but we need some information to respond to your request. If you do not agree, please do not send it to us.

f) In the case of Beneficiaries, we will keep a record of any correspondence. We will store only the data transmitted by phone that helps us fulfill the contract’s purpose. If you, as a Beneficiary, do not agree, please do not send us this information by phone.

g) Any other personal information you provide to us via phone is at your discretion. You must keep in mind that if you contact us via phone, we will keep a record of that correspondence.

Information Collected Contractually:

a) We will collect contractually only the information of the Beneficiaries, both at the moment of signing the contract between the parties and during the course of the activities that are the subject of the contract.

b) The Beneficiary holds this status only when a contract is mutually agreed upon and signed by both parties. Until that moment, the individual holds the status of Applicant, as described in this Policy.

c) The Applicant provides the necessary data for the preparation of the contract, and we will collect the following information: company name/individual name, registered office address/home address, VAT registration number, trade registry number, bank account and bank name, name of the legal representative and their capacity, contact person’s name and surname, as well as their phone number and email address. This information is necessary, and if you do not wish to provide it, we will not be able to conclude a legal agreement. Once the contract is signed, the Applicant becomes the BENEFICIARY. This information is not stored, so if an agreement is not reached and the contract is not signed, the data provided by the Applicant, as mentioned in this section, is not stored as it is not necessary.

d) To protect your data as a Beneficiary, we have introduced a confidentiality clause, described in the contract signed between the parties, to which you, as the Applicant, have access before the actual signing of the contract. If you, as the Applicant, do not agree with the terms mentioned in the contract, please do not sign it.

e) We will collect all the information you provide to us as the BENEFICIARY to fulfill the purpose of the contract. You choose to share this data with us (partially or fully). If you do not agree, please do not send it to us.

f) Any other personal information you provide to us through the contract, other than the necessary data for concluding an agreement, is at your discretion.

Automatically Collected Information:

In some cases, we automatically collect certain types of information when you visit our website.

Purpose and Use of Your Personal Data

Your personal data will be collected and managed by us for the following purposes:

a) To respond to your requests or inquiries when you contact us via the website, email, or phone.

c) To analyze compatibility with the job requirements provided by the employer, considering the vacant positions within our partner companies.

d) To create a summary, translating the data into an Employment Profile (a personalized CV), when we recommend it to the Beneficiary, but only if the compatibility with the vacant position is confirmed and only if you provide consent for submission.

e) To prepare and send an offer in the case of Applicants.

f) To fulfill the purpose of the contract, in the case of the Beneficiary.

Your personal data will be used in the ways described above and are permitted by the applicable data protection law, being:

a) Necessary for the purposes outlined above, and your privacy interests do not outweigh these purposes; or

b) Necessary for our legitimate interests, and your privacy interests do not outweigh these purposes; or

c) Necessary in some cases to fulfill our legal or regulatory responsibilities (e.g., providing information to competent authorities, government or regulatory bodies); or

d) Necessary in some cases to fulfill a task of public interest; or

e) Necessary when using certain categories of personal data, required for establishing, exercising, or defending legal rights and/or when the processing concerns personal data that is clearly in the public domain; or

f) Necessary in limited circumstances, processed only with your consent, which we obtain periodically (e.g., if you choose to receive future information about compatible job opportunities based on your job search criteria and areas of interest).

Emira HR does not make decisions solely based on automated processing (including profiling), or decisions that produce legal effects concerning you or significantly affect you in similar ways.

Retention Periods for Your Data

Emira HR declares that the retention periods for your personal data depend on the purpose for which this personal data is processed. These retention periods cannot be reasonably highlighted in an intelligible format within this Privacy Policy, as there are different retention periods for personal data and different purposes for which they were transmitted.

The criteria set forth in this policy are used to determine the applicable retention period in each case and confirm that we will retain your personal data as long as:

– You have consented/provided your agreement

– We need them for the specific purpose for which they were transmitted

– We need them to fulfill the object of a signed contract

a) For Candidates – To the Beneficiary/Beneficiaries (the hiring company/companies) when you express your consent after the interview for us to send your Profile to them. These recipients have contractual confidentiality obligations that they will respect and will use your information only for the purpose it was provided, namely for filling the vacant position. We have entered into a “RECRUITMENT CONTRACT” with them to ensure that your personal data continues to be subject to an adequate level of protection. Similarly, if a technical evaluation is necessary, the Beneficiary may transmit this information to an authorized third party (e.g., the department head to assess your technical skills as a Candidate for the job) or, in case of your employment, to the designated department responsible for managing personnel.

b) For all individuals and entities that have provided us with personal data – To service providers, contractors, and agents, only in exceptional situations, when we contract/employ other companies and/or authorized individuals in to perform various functions on our behalf (e.g., Recruitment Specialists, trainers, career consultants, team-building specialists). These recipients/service providers will have access to your personal data for the proper performance of the business activity and to fulfill their contracted functions. They are not permitted to use the information for their own purposes, except for the purpose for which it was provided by you. These recipients have contractual confidentiality obligations that they will respect.

c) For all individuals and entities that have provided us with personal data – To service providers, contractors, and agents, in exceptional situations, when we contract/employ other companies and/or authorized individuals to perform various functions on our behalf (e.g., hosting and/or maintaining the content of our website, providing certain website functions, etc.). These recipients will not have access to your personal data, but if they request to contact them for the proper performance of the business activity and to fulfill their functions, they may access this information. They are not allowed to use the information in any case. These recipients have contractual confidentiality obligations that they will respect.

d) For all individuals and entities that have provided us with personal data – To governmental authorities and/or law enforcement agencies as we consider, at our discretion, that it is our obligation to take this action.

Some personal data is stored physically, such as original signed documents that help us legally carry out our activity (e.g., Recruitment Contracts for Beneficiaries). These data are physically protected according to the law.

We strive to take all reasonable and legal measures to ensure that your personal data is treated with seriousness, safely, and in accordance with this Privacy Policy.

We provide (only if necessary) your information to the following categories:

a) To third-party providers, contractors, or agents in exceptional situations when we contract/employ other companies and/or authorized individuals to perform various functions on our behalf. Your personal data remains under our control, and we provide access only to the extent necessary for them to fulfill their functions. They are not permitted to use this data. These recipients have contractual confidentiality obligations that they will respect.

b) To Beneficiaries, in the case of Candidates. We have entered into a “RECRUITMENT CONTRACT” with them to ensure that your personal data continues to be subject to an adequate level of protection.

c) To governmental authorities and/or law enforcement agencies as we consider, at our discretion, that it is our obligation to take this action.

c) Right to Correct/Rectify Your Personal Data: You can request the update or correction of this information if you can demonstrate that changes have occurred regarding the personal data we hold about you and that it is no longer accurate due to these changes.

d) Right to Restrict Processing: In certain circumstances, you have the right to restrict the processing of your personal data. However, in certain cases, such restriction may limit the services you can receive from us.

e) Right to Object: If the processing of personal data is based on our legitimate interest, you have the right to object to the processing of your personal data, referring to your specific situation.
